PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ACCESSING OUR WEBSITE OR ENGAGING LSB CONSTRUCTION FOR ANY SERVICES. BY SCHEDULING A CONSULTATION, EXECUTING A CONTRACT, OR USING THIS WEBSITE, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS.
1. Company Information & Licensing
LSB Construction (“LSB,” “we,” “us,” or “our”) is a licensed construction company headquartered at 1901 SW 55th Lane, Ocala, FL 34471, serving Marion County and Central Florida. LSB holds the following active Florida contractor licenses:
- Certified Building Contractor License No. CBC1268858 — Florida Department of Business and Professional Regulation (DBPR), Construction Industry Licensing Board
- Certified Specialty Contractor License No. SCC131152196 — Florida DBPR, Construction Industry Licensing Board

These Terms govern all consultations, proposals, construction contracts, and website use. All formal construction projects are governed by a separately executed written Construction Contract, which incorporates these Terms by reference.
2. Scope of Services
LSB Construction is a design-build general contractor providing the following services in Ocala, Marion County, and Central Florida:
2.1 Luxury Custom Homes
- Full design-build custom home construction from concept through certificate of occupancy
- Architectural design, structural engineering coordination, and interior design consultation
- Custom estate homes with premium features: home theaters, infinity pools, smart home integration, private gyms, and similar amenities
- Pre-construction planning: site analysis, value engineering, Marion County permitting, and project scheduling
- On-site construction management with regular owner reporting and site meetings
2.2 Commercial Construction
- Design-build commercial construction projects across Central Florida
- Pre-engineered metal buildings and commercial structures
- Commercial project management, scheduling, and budget controls applied to every project
2.3 Equestrian Facilities
- Custom horse barn design and construction — private stables, multi-stall barns, and working farm facilities
- Indoor and outdoor riding arena construction, including hurricane-engineered covered arenas using pre-engineered metal buildings
- Arena footing and drainage systems — graded base preparation, drainage engineering, and footing material selection (sand, fiber/rubber blends)
- Equestrian facility site planning — traffic/workflow, manure management, hay/feed storage, round pens, lunging arenas, and hot walkers
LSB’s integrated design-build model provides a single point of accountability for design, engineering, permitting, and construction, eliminating communication gaps and budget overruns common in traditional delivery models.
3. Consultations & Proposals
LSB Construction offers initial project consultations to discuss scope, feasibility, budget, and process. The following terms apply:
- An initial consultation does not create a binding contract or obligate LSB Construction to accept a project
- Cost estimates and timelines discussed in a consultation are preliminary and non-binding until formalized in a signed Contract
- Custom home construction in Ocala typically ranges from $400 to $600+ per square foot. Horse barn construction typically ranges from $50 to $120 per square foot and above. These are general market ranges only — actual costs depend on site conditions, design complexity, material selections, and prevailing labor and material costs at time of construction
- LSB Construction reserves the right to decline any project at its sole discretion
4. Construction Contracts
All construction projects require a signed written Construction Contract prior to commencement of any design, permitting, or construction work. The Contract will specify:
- Detailed scope of work, project description, and technical specifications
- Contract price, payment schedule, and conditions for price adjustment
- Project timeline, start date, and substantial completion target
- Change Order procedures and authorization requirements
- Material allowances and owner-selection provisions
- Warranty terms for labor and materials
- Insurance requirements and certificates
- Dispute resolution procedures and termination rights
These Terms are incorporated by reference into all Construction Contracts. In the event of a conflict between these Terms and a signed Contract, the signed Contract controls.
5. Florida Construction Lien Law — Mandatory Disclosure
NOTICE TO OWNER — REQUIRED DISCLOSURE UNDER FLORIDA STATUTE § 713.015:
“ACCORDING TO FLORIDA’S CONSTRUCTION LIEN LAW (SECTIONS 713.001–713.37, FLORIDA STATUTES), THOSE WHO WORK ON YOUR PROPERTY OR PROVIDE MATERIALS AND SERVICES AND ARE NOT PAID IN FULL HAVE A RIGHT TO ENFORCE THEIR CLAIM FOR PAYMENT AGAINST YOUR PROPERTY. THIS CLAIM IS KNOWN AS A CONSTRUCTION LIEN. IF YOUR CONTRACTOR OR A SUBCONTRACTOR FAILS TO PAY SUBCONTRACTORS, SUB-SUBCONTRACTORS, OR MATERIAL SUPPLIERS, THOSE PEOPLE WHO ARE OWED MONEY MAY LOOK TO YOUR PROPERTY FOR PAYMENT, EVEN IF YOU HAVE ALREADY PAID YOUR CONTRACTOR IN FULL. IF YOU FAIL TO PAY YOUR CONTRACTOR, YOUR CONTRACTOR MAY ALSO HAVE A LIEN ON YOUR PROPERTY. TO PROTECT YOURSELF, STIPULATE IN THIS CONTRACT THAT BEFORE ANY PAYMENT IS MADE, YOUR CONTRACTOR IS REQUIRED TO PROVIDE YOU WITH A WRITTEN RELEASE OF LIEN FROM ANY PERSON OR COMPANY THAT HAS PROVIDED TO YOU A NOTICE TO OWNER.”
LSB Construction will provide a Notice to Owner on projects where legally required. Clients are strongly encouraged to consult a Florida licensed attorney regarding their rights under Chapter 713, Florida Statutes, before executing any construction contract.
6. Design-Build Delivery & Intellectual Property
6.1 Design Ownership
All architectural concepts, design drawings, renderings, engineering plans, and specifications developed by LSB Construction remain our intellectual property until full payment is received. Upon full payment, the Client receives a limited, non-transferable license to use the final construction documents for the specific project at the agreed property. The Client may not reproduce, transfer, or share these documents with competing contractors without our written consent.
6.2 Pre-Construction Design Fees
If a Client engages LSB Construction for pre-construction design, planning, or permitting and subsequently elects not to proceed with construction, the Client remains obligated to pay all fees incurred for design, engineering, permitting, and pre-construction services rendered to the date of termination, as set forth in the Contract.
7. Payment Terms
- A deposit is required upon contract execution to initiate design, pre-construction planning, and material procurement
- Progress payments are due at defined milestones in the payment schedule — typically structured around foundation, framing, rough-ins, drywall/exterior, and substantial completion
- Final payment is due upon substantial completion and Client acceptance as defined in the Contract
- All payments are in U.S. Dollars, exclusive of applicable sales tax, permit fees, impact fees, and other governmental charges
- Invoices not paid within 15 days of the due date accrue late charges at 1.5% per month (18% annually), as permitted under Florida law
- LSB Construction may suspend work for accounts more than 30 days past due, following written notice
- In the event of non-payment, LSB reserves all legal remedies including recording a Construction Lien against the property pursuant to Chapter 713, Florida Statutes
8. Permits, Codes & Regulatory Compliance
- LSB Construction obtains all required building permits for work within the agreed project scope unless otherwise specified in the Contract
- All construction is performed in compliance with the Florida Building Code (FBC), current edition, and applicable Marion County local amendments
- Equestrian facilities and agricultural structures may qualify for Marion County agricultural zoning exemptions from certain code requirements — LSB will advise Clients on applicable requirements
- Commercial construction complies with applicable OSHA standards, ADA accessibility requirements, and local commercial codes
- The Client is responsible for ensuring the project site is properly zoned for the intended use and for obtaining required zoning variances, HOA approvals, or deed restriction waivers
- Permit fees and governmental impact fees are the Client’s financial responsibility unless expressly included in the Contract price
- All electrical, plumbing, and mechanical work is performed by appropriately licensed subcontractors
9. Change Orders
- Any modification to agreed scope, materials, specifications, or schedule requires a written Change Order signed by both parties before implementation
- Change Orders will describe the change, its impact on the contract price, and its impact on the project schedule
- Owner-requested changes that increase the contract price must be approved in writing before additional work commences
- Unforeseen site conditions (subsurface rock, unsuitable soils, undisclosed underground utilities, existing code violations, environmental conditions) discovered during construction may require Change Orders — LSB will notify the Client promptly upon discovery
- Verbal approvals for scope changes are not binding on LSB Construction
10. Subcontractors
- LSB Construction uses licensed, insured subcontractors for specialized trades (electrical, plumbing, HVAC, roofing, concrete, and others)
- LSB maintains full accountability to the Client for the quality and performance of all subcontracted work
- All licensed trade subcontractors hold active, valid Florida contractor licenses for their respective trades
- Clients should direct all instructions and communications through LSB Construction, not directly to subcontractors
- Clients must not issue instructions to subcontractors or allow unauthorized contractors access to the site without LSB Construction’s written approval
11. Client Responsibilities
- Provide accurate and complete information about the project site, including existing structures, underground utilities, easements, deed restrictions, and HOA covenants
- Authorize LSB and its subcontractors to access the project site at reasonable times during construction
- Make timely decisions on material selections, design approvals, and Change Orders — Client delays may affect project schedule
- Ensure the site has access to required utilities (water, electrical, sewer/septic) in time to support construction
- Secure project financing before construction begins — LSB Construction does not provide construction financing
- Maintain adequate homeowner’s or builder’s risk insurance on the property during construction
- Obtain and provide evidence of HOA architectural review approvals before construction begins on HOA-governed properties
12. Warranties
12.1 Florida New Home Warranty Act (Chapter 553, Part III, F.S.)
For new residential construction, LSB provides the following minimum statutory warranties:
- 1 year from closing or occupancy — defects in workmanship and materials
- 2 years from closing or occupancy — defects in plumbing, electrical, HVAC, and mechanical systems
- 10 years from closing or occupancy — major structural defects that adversely affect the structural integrity of the home
To make a warranty claim, submit written notice to projects@lsbconstruction.us within the applicable warranty period describing the defect in detail.
12.2 Commercial & Equestrian Facility Warranty
Commercial and equestrian projects are warranted against defects in workmanship for 1 year from substantial completion, unless otherwise specified in the Contract. Manufacturer warranties on materials, fixtures, and equipment are passed through to the Client upon substantial completion.
12.3 Warranty Exclusions
Warranties do not cover: normal wear and tear; damage from Client modifications, improper maintenance, or misuse; acts of God, hurricanes, flooding, or fire; settling or movement from soil conditions not disclosed or discoverable through standard site investigation; or issues caused by Client-supplied materials.
13. Construction Timelines
- Custom home construction in the Ocala area typically requires 12–18 months total: 2–4 months design and planning, 2–3 months permitting, and 8–12 months construction
- Equestrian facility and commercial timelines vary by project scope and complexity
- LSB Construction is not liable for delays caused by permitting authority delays, supply chain disruptions, severe weather, force majeure events, or Client-caused delays including delayed approvals, change orders, or financing issues
- LSB will maintain a project schedule and provide regular updates throughout the construction phase
14. Site Safety & Visitor Access
- Construction sites are active work environments with significant hazards — unauthorized persons should not enter without coordinating with LSB’s project manager
- Client site visits should be scheduled in advance — unannounced visits to active construction areas present serious safety risks
- Children must not be brought onto active construction sites under any circumstances
- LSB Construction is not liable for injuries to the Client, their guests, or unauthorized persons who access an active construction site outside of scheduled, authorized visits
15. Insurance
- LSB Construction maintains Commercial General Liability Insurance as required by Chapter 489, Florida Statutes
- Workers’ Compensation Insurance covers all LSB employees on every project site
- Builder’s Risk Insurance covers the project structure during construction as specified in the Contract
Certificates of insurance are available upon request. The Client is responsible for maintaining their own property and homeowner’s insurance. Commercial project insurance requirements are defined in the Contract.
16. Portfolio & Photography
LSB Construction documents completed projects for portfolio, website, and marketing use. By executing a Construction Contract, the Client grants LSB a non-exclusive, royalty-free license to photograph and feature the completed project in our marketing materials without identifying the Client’s personal information or specific address. If you prefer your project not be featured, please notify us in writing before substantial completion.
17. Termination
- Client termination for convenience after contract execution but before construction: Client is responsible for all pre-construction costs incurred plus a reasonable overhead recovery charge as specified in the Contract
- Client termination after construction has commenced: Client is responsible for all work completed and materials procured to the date of termination, plus overhead and reasonable profit on work performed
- LSB Construction may suspend or terminate a project for Client non-payment after providing written notice and may record a Construction Lien for amounts owed
18. Limitation of Liability
- LSB Construction’s total liability for any claim arising from a construction project shall not exceed the total amount paid by the Client under the applicable Construction Contract
- LSB shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of use, loss of rental income, emotional distress, or temporary housing costs during delays
- Nothing in this section limits LSB’s liability under the Florida New Home Warranty Act or for gross negligence or willful misconduct
19. Force Majeure
LSB Construction shall not be in default or liable for delays or failures resulting from: hurricanes, tropical storms, flooding, extreme weather, acts of God, government-mandated work stoppages, permitting delays outside our control, supply chain disruptions, or labor shortages. We will notify the Client promptly and provide a revised schedule as soon as practicable.
20. Governing Law & Dispute Resolution
These Terms and all Construction Contracts are governed by Florida law. The parties consent to the exclusive jurisdiction of the state courts of Marion County, Florida. The parties agree to attempt good-faith resolution through direct negotiation for 30 days before initiating formal proceedings. Unresolved disputes shall be submitted to binding arbitration in Marion County under the Construction Industry Arbitration Rules of the American Arbitration Association. The prevailing party is entitled to reasonable attorneys’ fees and costs.

21. Severability & Entire Agreement
If any provision is found unenforceable, it will be modified to the minimum extent necessary and the remaining provisions continue in full force. These Terms, together with any signed Construction Contract, constitute the entire agreement between the parties and supersede all prior representations and proposals.
22. Changes to These Terms
LSB Construction may update these Terms at any time by posting a revised version on our website. The Terms in effect at the time your Construction Contract is signed govern that project. Changes do not alter a previously executed Contract without a signed written amendment.
